yeah...its just a bitch of a process and a waiting game. I hope the seller squares up. I'm sure you'd rather have a Uber or the $1900 to buy something else...

Paypal should work out well for you. I was on the other end of a Paypal dispute - I didn't include a whammy bar on a guitar (auction pics didn't show a trem arm, nor did I state in my auction one was included), guy I sold the guitar to wanted me to pay him $100 for a trem arm, I told him to pound sand, he had paypal freeze my account until we worked it out. If he hadn't dropped it then I think I would have had a hard time getting paid on the guitar.

Yeah but unfortunaly i have heard different things now, i have heard they can take money out of your bank account, and now i have heard they cant, actually i know someone that it happened too, a dispute against him, but they could only get the money that was in his pay pal account and not bank account, he cant use his pay pal account now because he has an outstanding balence, but they cant get anymore money out of him either. To make things short if they guy doesnt give the money on a volenteer basis then i have to file a dispute with my credit card to stop payment to pay pal. If that happens then it leaves the ball in pay pals court to sue this guy.

this is why i have a separate bank account for paypal. no money stays in it.

Like i said from my understanding they cant take money out of your bank account without your permission. Like i said i know someone very well that sold an amp to someone overseas to and unconfirmed address. To make things short the guy claims he never got it, filed a dispute and pay pal favoried him. Now my friend only had a like 200 dollars in his pay pal account so that is all they got from him on a 1000 dollar amp. His pay pal account is suspended and not sure if they will ever decide to take legal action. They cold take him to small claims court, but even if they win in small claims court it does not guarentee they will get there money. Unfortunaly i found this out about small claims court, it is not official and they cant do anything to you if they judge against you. The only thing i think they can do is add themselves to a crediter on his credit report.

And here is the reply from Bogner.
"This Amp was never a production Uberschall model, it was one of the prototypes built in 2001. This could be an amp which was damaged during shipping and salvaged, then sold by the UPS Insurance company as is. It must be as we only sold one of the prototypes and I remember that several years ago somebody called and said he bought this of the insurance.

                      [/ QUOTE ]

This is correct. I remember seeing this amp being up for sale several times on eBay. It is indeed one of the very early prototype Ubers. Someone on HC sold it and it was damaged in shipping. UPS paid the claim and took the amp. It wound up in their clearance warehouse where all their damage claims go to get sold off. Some asshat bought it from salvage and tried to resell it several times. I remember the 6550/EL34 switch and crappy looking gold text labels on the back. The same asshat even went to the trouble of buying a new head cab from Bogner (because the orginal was cracked in several places), but the stupid POS bought an XTC headshell... not a proper Uber headshell. Anywho, I remember someone did eventually buy the amp, but it didn't work when they received it. They called Bogner to see about fixing it, but Bogner refused because as they told you above, it was sold off to salvage. So don't feel too bad, I know there was at least one other person that was burned by this exact same amp. I would definitely let the seller know that you will take legal action if necessary if he doesn't give you a full refund. Total scam-alama-ding-dong. Sorry bro. Hope you get your money back.

That may not be true. If the perason has assets, you can file a lien on them. They can't sell the property without you getting paid in escrow. If they have a business you can hire a marshall to perform a till tap. He shows up with the judgement and directly intercepts customer payments
until your judgement's paid or until the guy pays up.

Some jurisdictions, if you can find the DV info on the guy's vehicle, whom you have the judgement against, the cops will put a Denver boot on the vehicle, that won't come off until he pays you. You just have to find out what property the guy owns, basically. The details vary but the judgement DOES give you power to collect. It just isn't automatic.
                        Ron is the MAN!!!!

if you can handle the wait, before you dispute it with your credit card, wait the 30 (or 45 days?) that paypal says is the window of time where they say you should let them facilitate the resolution.

the reason being is that paypal does not like credit card chargebacks and will only allow so many while the issue is still in their investigative window of time. if you do too many without giving them a shot, they'll cancel your account. but if it's outside of their window of time where they will investigate, they have no recourse but to let you file a credit card chargeback.

i would do the credit card chargeback seeing you'll get all your funds back. if paypal resolves the dispute, it's something less that the whole amount.

I will let pay pal do there thing, if they judge for me and cant get back my money then i will do the charge back. Considering this would be my first one where they couldnt get there money back i dont think they would be to upset considering the amount of money i make them from buying and selling gear. And if they do cancel my account at this point i dont care, i am pretty much sick of the whole Ebay/Pay pal thing and there is always Green Zap out there.
