Assuming Ellefson legally agreed not to use the name, then he's the in the wrong, not Mustaine. He's been in this business long enough to understand that if he agreed to such terms, then ignores them, he's breached the agreement and Mustaine has every right to persue a remedy. Strangely enough, it seems the majority of posts are pro-Ellefson. Why is Mustaine so despised? Inquiring minds want to know...

These two guys have spent the majority of their adult lives together. I'm sure both have seen the good, the bad, and the ugly. I bet both guys have enough dirt to bury the other 10x over. But what's it gonna accomplish. David sues Dave, then Dave sues David. I think a simple phone call saying "hey dude, you know you're not supposed to do that. I'm gonna let it slide this time, then I'm gonna ream you a new ass next time around" would have been sufficient.
