I reviewed UPS damage policy. The check goes to the shipper of record.

I recieved an email offering 1/2 of the purchase price back ($140) or we could go through UPS. I countered with $165. That will mean I paided $140 for this (shipped). Would that be worth it? It does sound good at least, even with 500 year old strings. And the neck is the thinnest I've played (I think I like the thinner the better). It seems wide as well.

Of course the check goes to the seller/shipper. Because he should have hypothetically refunded you. But if he hypothetically refused, then you would resort to a chargeback. Anyway, I'm glad the dude is being reasonable.

The cool thing about a $140 guitar that is cosmetically challenged but otherwise a player is that you can go to town on her with mods + "creative" refins + stickers + general abuse without feeling guilty.

What kind of headstock repair? Structural or just a reglued tip? If its no bigee, Id keep it for $140. Theres that guy who parts out jackson guitars on ebay and he has a buttload of bodies up right now. Id keep it for that price.

The break is on the top tip of the headstock through the low "E" tuner It's been glued back together (not the best).

No reply back. I'm surprised I got one at 9:44pm EST. This is a business "Auction Pawn 14" in Texas. I wouldn't think they would be working that late.

Tell the shipper/seller to start the claim process (you can actually start this as well), refund your money and you will leave a positive feedback. If the insurer denies his claim that's his tough luck. *YOU* paid for the insurance. It's *HIS* responsibility to recover the claim when damage occurs during shipping.

Also there is a return policy as well on the auction as well. Don't worry about the shipping as UPS will return it to him for free if one of you files a claim.

If he balks, do a chargeback or do a file a fraud report with eBay. The guitar you received is not the guitar you purchased. Plus he's not honoring the insurance process or his return policy. You have ample ammunition to come out whole here.

And even though the auction may claim "Seller not responsible for items lost or damaged during shipping, but will help in filing a claim," the seller is responsible for filing the claim. What SeventhSon said.

So I hope they make good and work with you on that refund. If it plays well busted, it should play even better with a chunk of your money refunded.

Undisclosed damage + crappy packaging + broken in shipment = return for full refund.

If the neck is repaired like that, and the body is damaged, I don't see it being worth $140+ shipping.

I know, but there auction says they won't refund the $25 shipping to me (even though it was their crappy packing job), and I'd probably have to eat another $25 to send it back. So I'd be out $50 for the experience. I'd rather take the money. I think the fair market value of the parts could be $140? If not let me know.
