  • Selling someone else's gear.

    Alright, this friend of mine, I don't really talk to anymore left a guitar at my house about a year ago, I've been bugging him to pick it up for months and I told him I was going to get rid of it if he didn't come get it, and he said he was going to grab it a couple days ago. He never did.

    It's a cheap epiphone les paul jr and I was thinking I'd just trade it in for a couple packs of bass strings. Is this wrong?
    I mean, if someone leaves something at your house and doesn't come back for about 7 years (to take it to an extreem) can they really expect it back fair and square?

    Am I wrong for getting rid of it even though he wouldn't come get it for months?

    To take it to an extreem, If I left a pack of gum at someone's house and they called me multiple times to come pick it up and I never did, could I just show up a year later and expect that they still have it?

    this is more of a karma thing than a legal thing. one could consider the guitar abandoned and yours to do with what you wish, but that'd be very uncool of you to get rid of it. if it bugs you that much, is it that hard to drop it off at the kid's house?

      I've considered it, I'm not really sure where he lives or what's up in his life right now though. Someone on another forum suggested I send written notice telling him to pick it up in ten days or else.

          I would tire of holding onto it, too, but I wouldn't just get rid of it without some final warning. If you know where to send a letter, then you have his address. Drop by his house and drop it off. Otherwise, call him, and ask for an address.

            I would just stick it in the basement, shed, attic or garage and forget about it until he came for it. Out of sight, out of mind. Then it won't bug you so much.
            Bad pool to trade it in though. It's not yours.

              This is a toughy. If you didn't like the guy I'd tell you to sell it, but seeing that he was a friend I don't know.

              Definately send a a notice though. I like it when buddies leave their stuff for me to play around with, but I don't consider myself free storage. And neither should you.

                Dropping it at his house seems like a good idea [img]/images/graemlins/smile.gif[/img]

                Even though you would have to spend the time and gas money to get there and back... at least you won't have to worry about it any longer.

                  I don't think you should sell it. Like was said earlier, put it in a closet and forget about it, someday he may come for it and you can discuss boarding fees! [img]/images/graemlins/laugh.gif[/img]

                    You need to document what you are doing. As soon as you sell it he's going to want it and you will end up buying him a new one. Unfortunately this amounts to sending him a certified letter or something along these lines. Either way it's likely that you'll end up on Judge Judy.

                      I second the put it up away somewhere and give him a pick it up or else.And even then I would just end up storing it for him I am a sucker that way [img]/images/graemlins/laugh.gif[/img].Like Sully said it is your decision but I know I could not dump it.

                        hell, my friend was in the same situation as you. it was a 1977 fender musicmaster with case. good condition, just needed a new nut. anyway, the girl never came to pick it up, so I traded him a Rat pedal for the guitar. and then i ended up selling the guitar on ebay for $350 lol

                          In Germany, he can theoretically come knocking on your door in 29yrs and 364 days and ask for it back, and you´d be boned.....

                          I´d send him a certified letter informing him that in 4 weeks you´re going to send the guitar to him COD (to cover shipping and packing) unless he picks it up or notifies you otherwise, and that if it returns you will do to it as you see fit, including selling it or destroying it, at your leisure [img]/images/graemlins/wink.gif[/img]
