Neal Moser and Moser Custom Shop are being sued by Kustom Musical Amplifications, Inc. (a subsidiary of HHI: Hanser Holdings International, and a corporate affiliate of B.C. Rich Guitars). The suit wrongly claims that neither Moser nor Moser Custom Shop has the right to build guitars involving Moser's own designs, including the Rich Bich, Moser 10, Genesis and Phoenix. The suit also wrongly claims that the “Spawn” & “Beastmaster” guitars infringe upon Kustom Musical Amplifications' trademarks. Neal Moser and Moser Custom Shop vigorously dispute the claims made by Kustom Musical Amplifications, and will pursue counterclaims against Kustom for its wrongs against Moser and Moser Custom Shop.
FOR IMMEDIATE RELEASE: B.C. Rich Guitars/Kustom Musical Amplification, Inc. and Moser Custom Shop/Neal Moser today announced a settlement of the outstanding litigation among them. The agreement includes Moser Custom Shop and Neal Moser's acknowledgment of B.C. Rich's ownership of the BICH trademarks and a trademark license from B.C. Rich to Neal Moser and Moser Custom Shop to produce a limited number of guitars based on the B.C. Rich BICH and SEAGULL guitar designs. As part of the agreement, Moser Custom Shop will cease production of the "Beastmaster" and "Spawn" models. Additional terms of the agreement were not released.
