    I case you missed that MCS was being sued, here's the original statement:

    Neal Moser and Moser Custom Shop are being sued by Kustom Musical Amplifications, Inc. (a subsidiary of HHI: Hanser Holdings International, and a corporate affiliate of B.C. Rich Guitars). The suit wrongly claims that neither Moser nor Moser Custom Shop has the right to build guitars involving Moser's own designs, including the Rich Bich, Moser 10, Genesis and Phoenix. The suit also wrongly claims that the “Spawn” & “Beastmaster” guitars infringe upon Kustom Musical Amplifications' trademarks. Neal Moser and Moser Custom Shop vigorously dispute the claims made by Kustom Musical Amplifications, and will pursue counterclaims against Kustom for its wrongs against Moser and Moser Custom Shop.
    And the result today:

    FOR IMMEDIATE RELEASE: B.C. Rich Guitars/Kustom Musical Amplification, Inc. and Moser Custom Shop/Neal Moser today announced a settlement of the outstanding litigation among them. The agreement includes Moser Custom Shop and Neal Moser's acknowledgment of B.C. Rich's ownership of the BICH trademarks and a trademark license from B.C. Rich to Neal Moser and Moser Custom Shop to produce a limited number of guitars based on the B.C. Rich BICH and SEAGULL guitar designs. As part of the agreement, Moser Custom Shop will cease production of the "Beastmaster" and "Spawn" models. Additional terms of the agreement were not released.

    "We are pleased to have this issue resolved to allow both companies to focus on building great guitars" stated Jack Hanser, President of B.C. Rich Guitars. Mr. Hanser continued, "Neal Moser is an important part of the history of B.C. Rich. This resolution results in an arrangement that is positive for B.C. Rich, Moser Custom Shop and guitar players." Neal Moser added, "Designing is like giving birth, the "Bich" guitar and other guitars I designed during my association with B.C. Rich are like my children. I am glad that we have reached an agreement and that these guitar shapes will continue to enrich future history for both B.C. Rich and Moser Custom Shop."

      In lawsuits like this- only the layers win. Looks like they beat the odds and fired the layers.

          SWEET, i wonder if he's gonna tell them they are building them wrong, i sure hope not. at this point bcr is laughable, the only thing the same is the BASIC shape & the names.

              Is it really such a great victory? Sorry to be a wet blanket, but if Neal can't build the Beastmaster or Spawn any more, and is only licensed to build a limited number of Biches and Seagulls, then don't BC Rich still win in the end? What about Neal's royalties? BC Rich still owe him thousands for using his designs.

                From what Neal has told me, the numbers that they've been "permitted" to build far exceeds what the shop will ever be able to make each year anyway.

                      What royalties? I don't know the details of the situation, but when you are an employee of a company, everything you create belongs 100% to the employer, not you. As an employee you have absolutely zero claim to any work you did, in perpetuity.

                        The lawyers. When you go to trial you lose, a settlement is always the best outcome.

                        By the way, while we do plenty of "laying" we are lawyers..not "layers"

                          That is 100% correct. (unless contractual provisions were made during the employment)

                            You need to know the history behind the designs. For example: The Virgin/Scythe was "licenced" to Class Axe by Neal and not BC Rich themselves. BC Rich took over the reigns after Class Axe and continued to produce the guitar without paying the royalties that were due...

                            My understanding is that Neal was never actually an employee of BCR, more like a Freelancer/Contractor. But anyway, if you want to hear it from the horses mouth you should go to the MCS forum.
