I would try to send back like others said.
You mentioned it had a case, I'm curious as to how both sides of the nut have brown mudges/damage on them, I can't see that happening during shipment if the guitar was in a case. How was it packed? Could the guitar slide back and forth?, and if so, could the headstock hit the end of the case if the box was tossed by UPS headstock down?
The said thing about the shipping industry is that they usually fall back on the 'insufficient packaging' excuse to deny any claim.
Did you buy from a store? If so, see if they will replace. If you bought from ebay, the shipper might have to initiate the claim process.

I remember seeing a $5000+ custom guitar arrive at One Flight Up. Man, it was a sad sight. A guitar that took MONTHS and MONTHS to build arrived with the headstock snapped clean off.
The guy only insured it for $100 LOL. Ohhh Kay then! Well, I'm not going to fret about this and am going to have it glued and plug it in then shred the heck out of it. It's somewhat of a beater.
Trust me, a few other guitars that I had some we're shipped through UPS right at a time when I had seen a LOT of threads here with broken guitars.
My old Jackson soloist made it to Finland ok. Trust me though, I was SH))in kittens until I received word it arrived un-scathed.

Was just chatting with my tech, he said "you like maple boards, let's pull it and put maple board on there LOL" he was serious. if it we're cheap enough, i'd do it!
as for selling it? nahh, i can feel some bonding already. i took off the tree trunk strings and put some regular .009's on it and did a quick intonation(wayy off) and lowered the pick-up(was hitting the high e under bends)
it really plays well and is quite resonant acoustically! not sure if these pups will stay in, or if i'll go to a jb(my usual) or Zakk "TRUE" EMG's.

sorry, i believe that the epiphone zw models (which this guitar is) have scarf joints. i don't think that gibson les pauls do.
