Yeah, it sucks. Music123 doesn't have any more in stock, so I'm getting a refund. Jeez, I've bought 2 Jacksons now and they were both broken. And I bought the first one in person!
On the bright side, keep an eye on the Guitars By Other Manufacturers forum for my forthcoming review of the Agile. Here's a preview; It's good.
wow that sucks man im sorry to hear your guitar was damaged.....my KE-3 had a crack in the neck cavity on the body from fedex as well when i first got it
The second KE3 I bought had no case. As long as the shipper knows what he's doing, it should turn out fine.
The first Kelly I bought (PS-6T body, Fusion Professional neck with ebony & MOP sharkies) had no case either, and was craptacularly packed. It cost that pawn shop $165 of the $305 I spend on it (they also did not disclose a repaired headstock on the low E tuner). Sold the body and pickups for $75, so I got a repaired Fusion neck, tuners and nut for $65.

Thank God, my KE3 came in it's Jackson case and undamaged.
[/ QUOTE ] I know I'm quoting myself. It appears I got lucky with my KE3. If there was ever a case for e-mailing a seller of a pointy to support the neck and head this is it. As well as the 475 that got it's head busted on another thread.
