$50 for setup? Maybe it's just me, but that seems steep. As for pulling the pickup to check it after saying he was returning the guitar, it's questionable but it really shouldn't have drastically changed anything. If we're talking relief and so on, changes in temperature could be to blame. Did he put new strings on or just restring it with the old ones? If they were new, were they the same guage? How is the setup "off" when tuned back to E standard?
Personally, I'd just stop all this drama on both sides and refund the money as promised. No damage was done, and any changes to bring this guitar back to the setup it had when it was in your hands at the first time should be minimal. Vector learned not to be so impulsive with his purchases, hopefully, and Mr Graphic learned that examining a guitar before shipping and giving full disclosure might save him a headache in the future.

I'm trying to point out that tuning the guitar back to E 440 isn't now and never has been equivalent to a 50 dollar set up. Point in fact, if we want to split hairs, the guitar arrived to me out of tune as well. Would the OP think it reasonable for me to charge him 50 dollars because I had to take 5 minutes to tune it back up? Seriously, yeah, I looked to find out what pick up was in it (it had NO markings on the top) but I replaced everything including the same exact strings that it came with. There was no change in string gauge that might require a intonation/set up... 50 bucks. Really?
We can debate about how much of a dick I am for being curious about the model of a pick up or for thinking that a guitar should be reasonably & accurately described but when all is said and done, the OP made an offer for a full refund less shipping and then did not honor it because the strings were out of tune. I thought folks would want to know about that kind of a shady deal...
