What a fuggin tool man.....

I just got a wire transfer from Belgium from Peeber for the glow in the dark, took 2 days, no BS, nothing, straight up transfer....

What a dickhead!

I would also turn his ass into the Internet Better Business Bureau as well, and the Better Business Bureau in Texas as well. Maybe someone local to him can give you a telephone number?

Sorry man, still hoping for the best for you.

Now, are you getting 100% of your money back? I would DEMAND that you get 100% plus at least $100 US if not $200-$300 just for interest and BS, if I ever get down to Texas man, I'm certainly going to pay that fukk a visit, maybe we'll see him at NAMM? Not just for the sh!t you've gone through but the sh!t he's put a lot of others through, including myself. I think I was one of the first to expose him for what he really is, or maybe it was the DK deal, dunno, but he's certainly a tool......

Best...

Pat

This is Bullshit....he's going continue to dick you around with some SOB story. Tell him you want fucking cash money NOW or you'll do whatever you have to do, legally or illegally. I'll go get $$ from him and wire you the money myself if you want. He's probabaly about an hour or so away from me...this fuktard is taking this shit way too fucking far.....you've been way too kind and way too patient and its time to get nasty!

And yes Jackson CAN do something about this. If you have a problem with a Ford vehicle, you got to Ford Motor Company's ass, not the dealership!!

the issue of liability for a contract never fulfilled or even received may leave Jackson out of the majority of culpability..at least I would think it could be a possibility.

Sure, if one would have a product received from the company and it was covered under warranty, then sure, there is a contractual obligation. What contract does Jackson have with Micha?
No I'm not a lawyer, but going after Jackson to be liable for a dealer... I suppose it could happen and Jackson could take it out of Easton, but again, no contract other what seems a verbal agreement with Easton on Jacksons behalf.
Seems a work order never even was drawn up. For Micha sake, I hope he has proof of sending the $$. I would think if JCMI got wind of it, they would or could (or hope) do something to at least cleanse their name of this. What? I have no idea.

Dealerships, they'll push wriggling their asses out of any contractual obligation they can if it saves them a few bucks-I have fond memories of Toyota doing this to me.

Trust me, being patient and nice can be a good tactic if the person is moral, fair and has a conscience for good business practice. Easton seems like a dickweed, at least in business towards customers. I commend Micha for his patience, but there will come a time where it will be Easton either produces or you draw a harsher hardline.

Interesting. What, precisely, in the interpretation of the law of agency in Texas makes you so certain this is the case?

[/ QUOTE ]

Nothing because 100% was an overstatement on my part. One of the factories I represented was sued for a pool pump tha was installed. In fact in the situation there was no manufactuer defect at all but since they were the ones with the deepest pockets they indeed get sued and paid 30 million dollars. It truly was a sad case but there is no reason the factory should have paid. So you are correct Jackson has some liabilty always but since KE never even informed Jackson of the order and Jackson has removed KE as an authorized dealer their liabilty is minimized but their responsibility should not be

sure he's lying.
that's what he did thru the whole deal I guess, but it won't change anything.
my tactic is to get him to a point where further excuses are hard to get. if he says he's having trouble with this or that, I'm not the one to proove him anything, I've got to take it as is.
he offered me another wire-transfer together with a tracking number for monday. that's it.
if he does, I can check that everything is alright, or get him down otherwhise. but at least, that's a point of no return for him.

I'm glad you guys gave me some hints on how to handle this, since I really didn't know there IS something like a tracking number for wire-transfers...
I've got no clue on how the game is played over in the states, but I'm starting to get a picture now slowly.

I'm not the one to get unpatient or angry easily. I'm really bad at those things, that's simply not me, but I will get what I want. even if it takes longer than it could go otherwhise.
that's just my way of things and living, and easton is not gonna change anything there.

and I don't want any extra-bucks or whatever, just my cash back that I can give my custom another try.
apology would be nice too I guess.

just seems like some of you guys are even more angry bout this than me, but you got to understand that I'm kind of used to living with this thing in mind. it's just nothing new for me.

if this is not gonna work on monday, I know I still do have you guys (thx for your offer shawn btw!), I will get in contact with the IFCC, the better buisness bureau, the IPA, DPD, jackson, my lawyer and his local press.
guess he will be surprised how much trouble I am.

but that's not only trouble for him, but also stressful for me.
this is running for years now, and I won't die if I have to wait till monday now.

thx a lot again for your information, I will keep you posted!!

I understand Micha but nice guys often get taken advantage of, I think KE is stringing you along because 1) you are a nice guy and 2) you are not in the USA. He's going to dick you around as long as he can get away with it. Pat has firsthand experience with him in that regard. I'm a very patient and nice guy too but when I get to the point where I feel that I'm gettting screwed... then I can be a ruthless prick if I have to be

OK Micha, plan #2.

Hire someone in the area Kevin 's store is located.
Tell that person to go to his store and collect the money.

I think this is the only way to fix this.
Since Kevin knows you aren't able to come by, he is playing with you.

Seriously, do not expect money coming by bank wire as he promised.
Unless someone goes to see Kevin in person and asks money from him, this will be endless.

I went through the same shit with Easton but instead of trying to get my money back I waited until he has something interesting in the store that I could get. It still wasn't easy so I can only imagine how hard it will be to get money out of him. Here is my story if someone hasn't read it before:

This thread will be endless... Sorry for you Micha. The only way to get the money will be a face to face visit. Get the cops involved. BBB of Texas too. Don't waste any time. He might close up shop soon and run. You won't be able to track him down. Do yourself a favor. Call the cops and the BBB and anyone else that you can get involved. The clock is rolling forward my friend. Go now and make the calls.
