na, you're not.
I ordered a custom rhoads over a year ago. no deposit, it's fully payed already, shipping included.
it really suxx to hear these news... seems like I'll have to give him a call, huh?

"at charvelguy; who cares?"

For for one thing...slander if shit slingin starts going beyond what can be substanciated and proven, but the main reason why I asked that was because I wanted a question directed at you.

How did you pay? credit card? I do not see it as being mentioned at all in any of your posts.

As far as contracts go, a contract should have existed between Easton and Jackson. Easton acted as a rep upon Jacksons behalf so there had to be a guideline of ethics as to how JCMI wanted business conducted.
So, I would think there would be a contract of sorts to which one could resort to other than verbal. Micha paid in full for a product and service by Kevin but he dropped the ball so Jackson eventually dropped him-not necessarily direcrtly related but still, lot to be said given the number of incedents on this board alone. He's going to have to go as far as he can to resolve it thru Easton first.

It would be along the lines as if I went to a car dealer and ordered a new car, but they didn't have any of the color I wanted in stock, so I pre-paid in full and the dealer never delivered it. Yes, I could get the manufacturer involved, but the issue of recovery is still directly with the dealership/indivudual that took my money.
However, I never would have walked out of that dealership w/o a receipt and or a copy of the purchase contract.

hey,
I didn't want to sound nasty (somehow it does look nasty to me now... ), just wanted to point out, that we're just exchanging facts in here. wanted to make sure you didn't get me wrong above, since I don't really get your first sentence.

but to answer your question; I did a wire transfer.
he asked for a cheque first but I could get him to a wire transfer, since this was cheaper and less hazzle for me.
still do have a receipt for it, but I guess that's it.

sure, I did some faults and, well, improvident things in this deal.
but as I stated out, kevins reputation seemed perfect to me.
long time jackson imploye, main sponser of the JCF, fast as hell in mailing, kind guy, good experiences with him before... he even used to answer his phone!!
I just thought like, well this is a small batch guitar, so they won't ship around papers for every single one. I read in here, that you do have a contract with jackson as soon as you order a guitar thru one of their dealers, and I just felt kind of safe there.
these venoms, as simply not ordering that guitar and giving false delivery dates on and on, seemed simply beyond what I expected.

I'd really like to know where the other guitars from that small batch are today. I read in the dealers forum in a post of kevs, that some gold pinstripes ones would still be available, but the others were gone... some of them have got to be out there, but they don't show up somehow.
would just interesst me, if he really did fuck up with jackson, if he just sold my guitar to someone not as around the planet as me, or if he ripped off another 12 people just the same way.
wouldn't change anything in my situation, but I really wonder what happened there, since I still don't get it.
"long story..." is all he said about it.

well, let's see if he shows up with a transfer and a tracking number tomorrow.
best regards///

If not, it´s more than time to go postal..... I would have long bought a plane ticket and gone over there in person, that bit of loss I would have sucked up for a trip to the states and the rest of the cash, but he would have paid for it in other ways

I don't know if this has been suggested, but if any part of this transaction took place through the mail, you might consider contacting the US Postal Service. As I understand it, they take mail fraud very seriously.

Well, I didn't take it as nasty.
If you didn't think its relevent, you are entitled to your opinion.

I'm glad you have a receipt tho. I've never done a wire transfer but I wonder if any coverage for purchased goods on it expires after a certain amount of time. At least the bank should have a record of it.

I believe a report of mail fraud may have a time limit on it also, a year? As far as him saying he sent a check/cheque via the mail, hmm, not sure if that is fraud as it is so much just a lie as he didn't actually use the postal service just like he never filled out the order or saying "the guitar will be ready soon" for the same.

well, it simply did take a while, before I concidered fraud at all.
since I alsways read about people waiting for their customs, and customs arriving after 11-12 months...
for 10 months at least, I just thought everything was going fine.
then he pushed me with his false attempts of refunding...
he always puts in a delay where he seems a chance to do so.

it's not like I didn't care for 2 years till I decided to do something...

dunno if this does mean a difference in legal-things tho...

about eastons presens here;
since you seem to have a different opinion on it, maybe you shoot me a pm. could be possible that I once again didn't mention my riscs and would just like to see what you're thinking about it.

@zerberus;
if I had the money to go over there, I wouldn't really mind to do so.
but it's just like slmoust everything I own is at eastons. I'm still in studies, and I'm glad to get out of the month without loss somehow. always takes me a while to afford my needs, it's not really that simple, so I just try to get around without first.

Micha, I'll pm ya on this tomorrow after you post if you haven't received anything yet. Consider your options, but be mindful that Easton has the ability to read your position on this if he so wishes.

actually, no, he doesn't. his account has been suspended for some time now.

micha, any chance you can get your money back with a guitar in his current inventory? if so, tell him that i can come and pick it up, and i'll ship it to you.

??

He already has the money and it looks like he has no intention of returning it. Getting a guitar instead seems like the most realistic way to salvage something out of this mess.

@sully; thx a lot for your offer, but I agree with dave there.
I wouldn't have done this whole custom-stuff, if I could have something like this in series. and eastons homepage seems to be down once again, at least the online shop is gone, and it's saying something bout rebuilt now for quite a while...
not to mention, I'm not gonna buy even a set of strings from him again.
not after this deal...

this would perhaps work faster, and I'd really prefer you doing the shipping instead of easton, since I doubt his reliability, but this is not an option for me right now.
but thx anyway.

I'm off for today now, it's getting late over here...
so I'll post again tomorrow after I called easton.

um. guys? i'm not suggesting that micha gives kevin a dime. how stupid do you think i am? jesus.

since he's been waiting how long for his money, it would seem that if he has a guitar that is the equivalent dollar wise, that i could go get it and ship the fuckin' thing to him.

apparently it's a horrible idea; i thought it would close the issue a lot faster, since it seems as if easton has little intent on refunding anything.

for the record, micha, i really do hope that you get your money.
