The one thing I keep thinking while catching up on all of this is that if Easton files bankruptcy, and micha still hasn't recieved his money...micha is well and truly fucked. Once bankruptcy is filed, only secured creditors will get some partial share of the pie, unsecured creditors (i.e. micha) are left with nothing.

I agree with Sully and RR0849, buy something that he has in stock that is worth the money you paid, and at least get something for your money.

If you keep letting Easton put you off, which is exactly what he is doing, you risk not getting a dime back.

Don't be nice anymore and let him string you along, tell him to wire your money immediately. Let him know that if that doesn't happen, the next time he hears from you will be face to face because you're flying over and you'll be inviting the authorities along with you when you stop in for your money.

Quit being nice and go for the throat, he's led you around much too long.

The thing about the authorities is that it will most likely be a "civil" matter and we all know what that's about, well, most of us anyway....

I understand that it is a civil matter, and there's jack and shit the police can and would do about it.

I feel that it's time for micah to get more aggressive, and sometimes you have to bluff your way into what you're wanting. With that being said, micah should file a complaint with the Better Business Bureau of Texas, and also file with the Attorney General's office for starters. After that is done is when I would hit Easton with the I'm showing up ploy. Because once micah files with the BBB and AG, Easton is going to have to respond in writing. That my friends puts the ball back in micahs' court because he has something to bluff with.

This shouldn't necessarily be about Kevin E. winning or losing, it should be Micha getting something for his money. Best case scenario would be a full refund, but as we've seen, there seems to be an issue with Kevin E. with getting the money to Micha. So what's a viable solution? Well, I'd say that getting something that Kevin has already paid for. (he's gotta pay up front for his stock doesn't he?? [Not sure about the dealings of retail guitar stores])

It's not giving Kevin business, that's already been done. The problem is that the deal didn't work out, so it's time to get something out of it.

I don't think everyone understood what I meant by getting a guitar instead of the money back. I used the money I had in at Easton to get a guitar that I knew I could sell forward and get my money out of it. It was a lot easier cause Kevin's empty account wasn't an issue (how to do a wire when you have no money?!?!) and I got to try a very cool guitar in the process. And in the end I had all my money back and now I can tell Easton to go f&#k himself!

Again - if Kevin doesn't have the money to pay back he can't even if he wanted to. His funds may have been freezed already.

As a reference - Robert Witte didn't get any money out of Easton even though he had Fedex and VISA involved.

When it comes down to it, this really is a sorry mess, but I tend to agree with the 'get a guitar out of this quick before he goes to the wall' brigade....mind you, I'm not sure that he has anything worth taking now.

The difference between Micha's case and Rob W's is that (assuming this is what Jani is referring to) Rob was trying to get compensation for damage caused as a result of poor packing, rather than a refund for non-supplied goods. I can imagine that the claim would get stuck between KE saying that FedEx caused the damage and FedEx saying that it was improperly packed, and there would be little that VISA would do: At least Rob got the guitar.....

In Rob's case Kevin promised to do something about it and never did. He also screwed the original owner of that guitar.

I thought about taking a guitar 'in trade' for my money when I was going to get mine back. I am glad I didn't do it. Kevin is not hurting for business. Every time I have been in his store it's been busy and people are buying things. He may be hurting for money but it doesn't show. He gave me a check and I deposited that day. It cleared the next day. It was a good chuck of change as well.

Micha should get his money back. I think Kevin only has the Charvel Star and another 25th Anniversary hanging at his shop that are worth much. He has a bunch of import Jackson's and some used ones. If a guitar is shipped to Micha then he has to worry about it arriving in one piece. We all saw the Pre-Pro thread a while back and the debacle that was.

Get the authorities involved now.

The only reason I didnt want to have this established isn't because I'm fearful of Mr Easton. I really would not want to have Easton know anything that would allow him to gain more of an upper hand against Micha..period.

I would hope Easton is suspended given the practice of thivery to JCF members he has show to be repeating itself.
