      No and it's funny because last year he requested we remove his banner here...

      To futher show it's not smart thinking, he's linking his potential customers to a site with a thread such as this one ..there's good business sense

        I wonder how many more people are out there that have a guitar "on order" with him. In 6 months I think this thread has alerted four people. One every month and a half or so. Should some of the more popular forums have a link to this thread to get the word out?

          I've noticed from the old MoAIP that Kevin likes to recycle pages when he's working on website stuff. (As do I, it saves time) I'm sure that it's possible that Kevin really doesn't realize it's still there.

              He actually has, or did, quite a bit of gear in his shop. Some of it pretty nice. The guy just has no money sense and was probably using all our deposits to buy his new boat and booze. It all caught up with him.

                Winning in small claims court doesn't mean you automatically collect your money. You need some local help in the area because you will first have to check with the county tax assessor's office to see what real property he owns (house, land). Also check with the DMV to see what vehicle he owns. You can also, if you sue him personally AND sue him as a business, hire a local marshall to go to his shop and perform a "till tap". That's when the marshall takes in the shop's receipts until such time as the judgement is paid. People usually write the marshall a check pretty fast just to get the cop away from their cash register! I bet that'd get Kevin's attention! He would probably not even show up for court, but he can't ignore a marshal standing next to his till!

                I would be prepared to immediately file the till tap as soon as you win the case, since I would not expect him to pony up just because of a judgement. He may already have several judgements for all we know, but lots of people don't realize they are responsible to enforce getting paid.
                Give him the old one-two punch and you'll get your dough.

                My experience was with California small claims law;. Texas law may vary procedurally but I imagine the same recourse is available, you just have to do it the way they want.

                  Massachusetts law is exactly the same. Winning in small claims court doesn't mean anything, but getting a judgement in your favor allows you to put a lien on whatever property the defendant might own.

                    Quick update to the situation.

                    I still don't have my money.....

                    After complaining to the BBB, I recieved a letter with a reply to the claim by Kevin Easton on October 30th. The letter said all the previous things mentioned about losing $12,000 by his accountant swindling him. He also stated that the issue would be resolved by November 1st which it was not. I gave him a few days and left a message on the machine stating that I was giving him a week before pursuing legal action. Still nothing. Some personal stuff then came up and it's now November 26th. I just filed another complaint with the Texas Attorney General. I'll be sending them the copies of my Cashier's Check this week. I'm also going to request all required forms to file suit in Tarrant County Small Claims Court this week. So, that's where it stands.

                        A long, long time ago (just after college, when I was still poor [img]/images/graemlins/tongue.gif[/img] ) I had to do the small claims court thing with a scumbag landlord. It was not fun at all. A lot of hassle just to get into the courtroom. ...But then it turned hilarious. The judge went through the claims, and then free-style asked myself, my roomate and the landlord questions. During that testimony, we nailed the douche lying to the judge several times. Disagreed with his own testimony, even! We all left the courtroom rolling laughing. I think even the judge got a laugh out of it. He eventually paid after he realized we could garnish his wages.
