        How do they know you were drinking if you left the scene? My brother in law got out of this and he did the exact same thing but walked home. When the cops got there he had a beer in his hand. That way they can't prove the booze was in your system when you crashed. His excuse?? "I had to calm myself down.. I loved that truck" It worked.. and ticked the cops of tremendously. Failure to maintian control of vehicle and leaving scene of accident (which was dropped b/c nobody else was involved and he was out in middle of nowhere) was all he was charged with.

          A public defender is probably not going to do a great job for you. To me it seems a conflict of interest, since they work for the government that has an interest in fining as well as jailing you. Better than nothing, I suppose, but if you can afford an impartial attorney, I think that'd be better.

          I didn't leave the scene, but my attorney got me off with 2 days, which is actually the normal for first offense DUI in California, or was in 1992. Judge called it time served because I was booked at 10 PM that night and ORed at 6 AM the next morning, so 2 different calendar dates, but really only 8 hours in custody.

          The attorney only charged me for 1 hour too! Pretty cool, but his office was right across the street from the courthouse so it was convenient for him. Good thing he was there too, because it turned out thare was another guy in the system with my name AND birthdate, who was a few years younger, and who had several prior convictions (I did not).

          The attorney came up to me saying "WTF! You said you had no priors, what's this shit?". Luckily that guy had a distinctive tattoo on his shoulder, and I di not, so I proved to the attorney's and judge's satisfaction that he was not me.

          That alone was a good reason to have had a lawyer. I would have denied it was me, of course, but would I have thought about the tattoo? Might have gotten slammed by the judge if not.

            80 days for DUI is nothing, in Canada the times are huge for that, which is good, Keeps idiots off the road.

            If you were that drunk, you obviously shouldn't have been driving a car, so you earned 80 days IMHO.
