    Dude if you go to court with some medical documentation ...that could only help you...they may throw out the points..in your scenario the odds are in your favor...give it a shot

    but if your going to mention that you have IBS..then please bring some medical document to proove it...otherwise it's just another silly excuse to the court.

    Like I said ..in Cleveland I have power ..even though I'm retired , but all the cops still know my crazy ass so I have some leverage here...

    but that's the best advice I can give you.

      In Pennsylvania, when you sign the ticket, you're acknowledging receipt of the ticket. To admit guilt, there's a seperate place to sign on the back to plead guilty. If you don't sign the ticket, the officer just writes "refused to sign" and initials it, and you're less likely to get favorable treatment from the magistrate at your hearing.

        I got pulled over by a cop on a horse one time for making a turn onto a street where no turns were allowed! I probably should have just gunned it and took off... I mean, how fast could the horse really run? [img]/images/graemlins/laugh.gif[/img] When it was time to go to court, I was living out of state at the time, I wrote a letter to the court, they dismissed the ticket. [img]/images/graemlins/grin.gif[/img]
        I feel my soul go cold... only the dead are smiling.

          I can actually do better, remember how I recently posted I had a colonoscopy? They gave me an informational pamphelt on IBS, I can bring in my prescriptions, and the pictures of my colon (I'll probably leave that at home :P )I can also show that my prescription is being changed. I complained to the Dr. that the medicine made me shat less, but the urgency was still there, kind of like, there's no warning. He gave me a new medication, Donnatal, and I just didn't get to finish it yet.

            In Minnesota, you sign the ticket, it is an admission of guilt.
            I photocopied the last one I got.

            on the front bottom: (just as it appears)
            WARNING:
            1. Failure to respond to this citation within twenty-one (21) days will result in increased penalties and fees assessed; a WARRANT may be issued for you ARREST and your Driver's License may be SUSPENDED. The amount due may be referred to the Minnesota Department of Revenue, which has collection authority and they may access non-public government data for the purpose of expediting collection.
            2. Failure to appear for a Petty Misdemeanor will be considered a Plea of Guilty and waiver of your rights to trial unless the failure to appear is do to circumstances beyond the person's control.(M.S. 169.91)
            3. If you fail to appear or to comply with the Court relating to a Motor Vehicle Citation, your Driver's License will be suspended by the Commissioner of Public Safety (M.S. 169.92)

            and on the reverse bottom:
            TO ARRANGE A COURT APPEARANCE OR TO APPEAR BEFORE A HEARING OFFICER, CONTACT THE VIOLATIONS BUREAU AT 612-348-2040
            If you plead guilty by paying a fine, you waive your right to:
            1. A trial to the court or to a jury;
            2. Be represented by counsel;
            3. Be presumed innocent until proven guilty beyond a reasonable doubt;
            4. Confront and cross examine all prosection witnessess; and
            5. Either to remain silent or to testify for the defense.

            ONCE YOU HAVE APPEARED, ALL FINES ARE DUE ON THE DAY THEY ARE IMPOSED.

              OK last advice given.
              Go to court, admit to the judge that you were in the wrong & explain that you know that they have heard the excuse before about having to go to the BR, if ya have to bring a Dr's excuse stating that you indeed have IBS-irritable bowel syndrome, & that you did not mean any type of disrespect to the law. When most officers don't show for court on that day the judge/magistrate just assigns another court date, however as previously stated states vary, hell cities & county vary, don't get an attorney, most cops & prosecuters look at it in a since, well he can afford an attorney so he can certainly afford the citation, also when you sign a ticket/affidavit you are not admitting to guilt, you are promising to appear in court on the given day, most people don't realize that a speeding ticket is a misdemeanor offense that is committed in front of the officer, so therefore he can actually arrest you for that but most chose not to unless the offender is a real ass. Look bro, go to the prosecutor & talk to him as I stated before, bring a Dr's excuse with ya, that is very vital, hope everything works out for ya, let us know how it goes.

                Most of you know, I am a Police Officer, and I hand out speeding tickets on a regular basis. There is a lot of good information in this thread. However, every state is different, so do some checking into your local laws. You should definitely contest the ticket, and go to court, you have nothing to lose. The Trooper that wrote the ticket is required to appear in court, that is the same in 50 states, guaranteed by the Constitution. If he doesn't show, you have won, the ticket has to be dropped. But just to put this in perspective, I have never lost a speeding trial. If the Officer shows up, you will more than likely lose, but to what extent? Bring your medical records, like Bill suggested, better make it a doctors note, not prescriptions or pics of your colon! lol Even though I have never lost a speed trial, the judge almost always reduces the fine. Doesn't help you in the points dept. but most states do offer some sort of 'traffic school' to take points off of your license. No lawyer necessary, that is a waste of money. You can ask to see the Officer's radar certification, the radar instruments certification, and ask the Officer if he checked the unit with the tuning forks, and checked the machines internal tests (pushing a couple of buttons.) Hiding is perfectly legal, that is an urban myth, I wouldn't suggest bringing that up. I hope that this helps. Good luck!

                  Just to add. You can go to court and fight this and it will not be a trial. Nobody wants a speeding trial unless they have a really strong case, a witness and something really strange happened 'cause if you can't make it right between you and the state before the jury selection, then the prosecutor and the judge will nail ya pretty heavy with court-state fees if you do lose.

                  Plan on spending at least a couple hours with the clerk at the preliminary hearing. Depending on the law, in some instances they can clear this up there at the violations bureau, otherwise you spend about 5 minutes with them - they schedule you for court. Plan on about 1-4 hours for court, but you should be able to get it resolved before they break for lunch.

                    Tonight at work, I called the State Trooper barracks where the officer works out of. I asked to speak with him, or leave him a voice mail/message, and it so happened he was there!

                    I stated my case, just like this,

                    "Would you mind if I had a moment of your time to speak about the meeting we had on Friday? I understand you have a job to do, and that it can make some people unhappy. I also understand we have a difference that needs resolved *(my way of saying I'm guilty minus the guilt part). I would like to know, if it is possible to reduce this to a fine with no points penalty. I've no problem paying a fine, but the points are my main concern. If you look at my record, you can see I've had one incident, which goes away in Feb." " I also said, I know you cannot let everyone off who has the bathroom excuse, but I can show you my medical documents that I just had a colonoscopy, I can show you my medical charts where I told my Dr. the urgency is still there, even with the medication. I again stressed, I know this is not your concern, or your problem, and I'm willing to pay the fine, I just would like to see if we could reach an agreement." He said, sure that is not a problem. He gave me the district justice's phone number in the town I will be pleading. He said, call him, let him know that you spoke to me. Tell him you've received a traffic citation from me, but I've agreed to let you plead guilty to a 3111A, which is a no points, not reported to your insurance offense. If he has any questions, have him call me.

                    I said, "thank you very much. I was telling my friend, who happens to know a trooper, that I was going to go to the magistrate and ask him the same thing, I just asked you, and he said that it would be better to call you first. He said, police officers are human too, and don't want to be bothered around the holidays with trials, and I may be able to talk to him.

                    I'm calling the justice tomorrow, letting him know what the officer told me. I'm going to then go to his office, and ONLY plead guilty to the 3111A if the other ticket gets completely thrown out (meaning I don't end up with 2 fines! [img]/images/graemlins/smile.gif[/img]

                          That was a very calm, rational and professional way to deal with it. I'm glad it worked out and the officer was probably glad to see someone trying to work with him instead of just fighting it. [img]/images/graemlins/cool.gif[/img]

                            here in NY the cop gets 3 no shows, unless you know the legal terms to have it dismissed for failure to prosicute in a timely fashion. also if on the back of the ticket it lets you get a supporting deposition request one & send it in within 12 or 24 hours i forget. if you do not recieve a supporting depostion within 30 days the ticket will be dismissed in court when u get there. but the ticket & request for the supporting deposition must be sent registered mail with 12/24 hours of the issueing of the ticket. there are some other ways around tickets like that, lawyers usually have a better chance of getting a ticket reduced or dismissed than you do. ive had many, tickets. every state & county is different, so talk to a lawyer & do it ASAP.
