Chances are very slim to none that Rape would only warrant a paper conviction.

here in Ohio...13 and under IS rape no matter what..

if serious physical harm was cause then of course there would be guidlines the court would take into consideration....and they would just tack that onto the sentence.

I'm not a lawyer / city prosecuter ...so I don't know of all the court legistics...but I do know the law as a police officer..

and Rape is Rape where I come from....which carries certain jail term....it is a Felony..whether it is a Felony 1 , 2 , 3 or 4 depends on the severeity and circumstances of the case..or "guidlines".

Corruption of a minor...well that could get you Jail time and or Probation...probably five years I would guess..

but MOST felony cases get "some" jail time...depending on venue , criminal code...and priors...that matters a lot as well....The suspect/defendant's criminal background.

I can't say anything against him over the girls' ages. Both my grandmothers were married at age 13, having babies by 15. Their husbands (my grandfathers) were both in their mid-to-late 20's. These were of course consentual situations, not only with the girls but with their families.

Maybe setting the "age of consent" at 18 was the best solution anybody could come up with, but I think it also creates many problems. All the unfortunate "barely 18" porno stuff and Alyssa Milano's brief rebellious period comes to mind.

I am IN high school and see/know plenty of freshman that look 17 or 18. And I'm plenty sick of all this "let's hang everybody" shit I hear on any message board I see. I'd like see what your perspective is if you get arrested for something you didn't do, or is bullshit (ie a freshman/senior relationship). That said, I don't even know any Static-X songs, could care less about this guy, and it seems so far he's a creep that's obviously guilty. End drug prohibition and there we go, plenty of room for anyone who even looks at a minor the wrong way.

It's true a 14 year old can LOOK 18 or older, but 5 minutes of conversation should clear up the matter. As for saying she deceived him, have you heard any evidence of that in either of the TWO cases THIS MONTH for which he was arrested? I haven't, but I read they siezed several computers looking for more victims. He said in his 20 Questions interview at Metal Sludge that he likes to talk online with people of "all educational levels, including elementary school". He has some real traits of a pedophile. The guy getting hoodwinked by 2 girls in a month's time, doesn't sound feasible. Maybe he's just cheap and the 18 year olds make him get a room. He's boning these kids in a car like he's in high school.
For a 39-year-old guy to bone a 14-year-old girl is pedophilia, plain and simple. He could ALMOST be her GRANDFATHER biologically for Pete's sake!

My past as a lifeguard and my current work as an educator make it easy to tell the differences between someone under consenting age and those whom are over 18. Its easy.

Wow, some interesting points here.

Here is what our criminal code in PA says,

Rape (Section 3121) - A person commits a felony of the first degree when he or she engages in sexual intercourse with a complainant:
By forcible compulsion.
By threat of forcible compulsion that would prevent resistance by a person of reasonable resolution.
Who is unconscious or where the person knows that the complainant is unaware that the sexual intercourse is occurring.
Where the person has substantially impaired the complainant's power to appraise or control his or her conduct by administering or employing, without the knowledge of the complainant, drugs, intoxicants or other means for the purpose of preventing resistance.
Who suffers from a mental disability which renders the complainant incapable of consent.
Who is less than 13 years of age.

What I gather from this is, if she's 13 or older, it's not rape, if shes under 13, it's rape. Also, what I gather from this is, say some 12 year old is saying she wants you and the sex is consensual, IT IS STILL RAPE.

This is our criminal code for kidnapping,

Kidnapping (Section 2901), when the victim is a minor - A person is guilty of kidnapping if he unlawfully removes another a substantial distance under the circumstances from the place where he is found, or if he unlawfully confines another for a substantial period in a place of isolation, with any of the following intentions:
To hold for ransom or reward, or as a shield or hostage.
To facilitate commission of any felony or flight thereafter.
To inflict bodily injury on or to terrorize the victim or another.
To interfere with the performance by public officials of any governmental or political function.

I'm not sticking up for him, but sleeping in a car with a "rockstar" is not exactly kidnapping. Again, details could be witheld so we don't know all of them, but I don't think he kidnapped anything.

Involuntary Deviate Sexual Intercourse (Section 3123) - A person commits a felony of the first degree when he or she engages in deviate sexual intercourse with a complainant:
By forcible compulsion;
By threat of forcible compulsion that would prevent resistance by a person of reasonable resolution;
Who is unconscious or where the person knows that the complainant is unaware that the sexual intercourse is occurring;

Okay, what I gather from this above text is, it's the same as rape, but with the added, if your not married, and you're 20 and she's 16 kind of deal.

Sexual Assault (Section 3124.1) - Except as provided in section 3121 (relating to rape) or 3123 (relating to involuntary deviate sexual intercourse), a person commits a felony of the second degree when that person engages in sexual intercourse or deviate sexual intercourse with a complainant without the complainant's consent.

This also looks just like rape, just another circumstance.



Okay this part is particularly interesting,

Obscene and Other Sexual Materials and Performances (Section 5903(a)(3), (4), (5), or (6), where the victim is a minor -
(a) No person, knowing the obscene character of the materials or performances involved, shall:
(3) design, copy, draw, photograph, print, utter, publish, or in any manner manufacture or prepare obscene materials;

(4) write, print, publish, utter or cause to be written, printed, published or uttered any advertisement or notice of any kind giving information directly or indirectly, stating or purporting to state where, how, from whom, or by what means any obscene materials can be purchased, obtained or had;

(5) produce, present or direct any obscene performance or participate in a portion thereof that is obscene or that contributes to its obscenity; or

(6)hire, employ, use or permit any minor child to do or assist in doing any act or thing mentioned in this subsection.

In this section, minor means any person under the age of 18 years.


That means, if she said, hey I'm 16 or 17, whatever would make the sex legal, even with the age difference, and send him some naked shots, it falls under this.

Sexual Abuse of Children (Section 6312)

There are several sections to this part of the criminal code, however the one that is REALLY important to this discussion is this,

(e.1) Mistake as to age - Under subsection (b) only, it is no defense that the defendant did not know the age of the child. Neither a misrepresentation of age by the child nor a bona fide belief that the person is over the specified age shall be a defense.


That means, it don't matter if he didn't know it doesn't matter.

A few things I'd like to say,

Rape is wrong. Having sex with minors is wrong. Coercing minors into sexual acts is wrong.

I'd like to say a few other things that are wrong too. When someone (say a 16 year old in some cases) lies about her age, and has sex with a man, then he gets in trouble, for CONSENSUAL SEX. I don't agree with underage sex, and if I have ANY shadow beyond a doubt, I would ask to see some sort of ID or whatever, corny as that sounds, it's the truth.

Another thing I think is wrong, and if you act like it doesn't happen, you're sadly mistaken.

There are rapes that are yes tonight no tomorrow. What I mean, you sleep with a girl at a party or something. She thinks you want a relationship, well guess what, you didn't, so she says you raped her. Or say someone goes to a party, cheats on her boyfriend, her boyfriend finds out, and instead of saying I'm a cheating slut, she says she was raped.

It happens, and people are convicted of it.

I know rape happens, I know people are violated, and I think it's wrong for that to happen. I think the people who commit these crimes need punished to the fullest degree, and I agree with that very much. I think if you're fucking kids, you should be sent to prison (I would say killed, but child molestors get the shit fucked/beat out of them in prison, so they get the same treatment they gave someone else.)

I think sexual crimes are some of the most violent crimes, even if a single hit isn't made. And there's a few reasons for this,

Murderers sometimes get off with less time, and not even a felony conviction. Why? Murder is the least repeated crime. Generally someone who kills, doesn't do it again. This is scientific fact. Yes there are expections to the rule, but think about it. You kill your wife for sleeping with someone, you're not going to kill her again.

Sexual predators on the other hand REPEAT their crimes, generally any time they can. Again, expections to the rule, maybe someone did something, and they truely feel awful about it, have done everything they are supposed to, and tried to atone for it to the best they can. It doesn;t mean they didn't do the crime, and they are still pieces of crap, but I digress.

Sexual crimes are repeated, and often. Usually a woman is raped by someone she knows, and in quite a few cases, more than once by the same person.

For every 1 rape reported, a few go unreported. I don't know how the statistics for this are correct, so I'll say a few, and this is why. You probably have quite a few people who would lie on a survey about it, or still people on a confidential survey who would not comment on it, so the numbers are padded, so I refuse to give the actual statistic data, and I'll just say, that quite a few go unreported for everyone that is reported.

That's all interesing for PA, but the incidents happened in New Jersey and Orange County, CA, so the laws there would prevail.
Not saying they may not be similar or the same
but if you're interested in what might happen in this case the actual state laws where the act was done will apply. Unless him driving from PA to NJ somehow makes it Federal, but I don't think so unless he drove her cross the line.

Regardless of him being a rockstar or her underage "consent", a man of 39 having sex with a girl of 14 should be statutory rape. If it's not, it should be.
