      Food for thought.
      1. Jerry Lee Lewis married his 13 year old cousin.
      2. Jon Stewart did a bit on Mary LeTorneau marrying her "victim" (she was the school teacher who had sex with her 13 year old student). When Jon Stewart was trying to recall the name of the boy, he paused, feigned like he couldn't remember the name, then grinned broadly and said, "the luckiest kid in America!" He knows that there is not one 13 year old boy who would pass up the chance the boink a teacher. But the media keeps on referring to the kid as "the victim".
      3. Great scene in One Flew Over the Cuckoo's Nest where Jack Nicholson is talking the the shrink about his crime (statutory rape) and he was saying something like "she was 16 going on 30 if ya know what I mean doc! when you're staring at that beaver..." I forget exact line...I should rent the movie again.
      4. What about a HS Senior who's been boinking his Freshman girlfriend for 2 years, then he turns 18, but she's still 15. Is he a pedophile?

      Don't get me wrong, this Tripp Eisen guy sounds like a bona fide pedophile and creep.

      As to whether the law accurately defines pedophilia such that we can definitively point to someone and say, "yes, he's a pedophile according to such and such statute"...

      The problem is that the law has to be unambiguous but life isn't. It's kind of like porn. It's very hard to define, but you definitely know it when you see it.

          1. He married her - if you are legally married to them is not considered statutory rape. But you can still rape your wife/husband.
          2. There are a lot of people (boys and girls) that do not want to have sex with their teacher or other adults, but still get coerced. They live with this for the rest of their lives.
          3. In some states it would not be statutory rape - depends on the laws of that state - many include the phrase "if the victim is --- years or under and the offender is 2, 3 0r 4 years her senior" then it is not within the definition of rape.

          And there is generally a separate definition of pedophilla and statutory rape. They are not necessarily the same. Yes the rape laws need to be reworked. But there are a lot of rapists walking the streets right now because victims are afraid to come forward - especially if they were young or the person has some standing in society. Because rape kits are not processed. There are those of us who were the victims and never had our day in court for many reasons.

          Generally, rape/sexual assault sentences are not long enough and can't be compared to what a victim gets. We get a life sentence without the benefit of judge or jury.

                    This is the state of IL law on that: (4) commits an act of sexual penetration with a
                    victim who was at least 13 years of age but under 18 years of age when the act was committed and the accused was 17 years of age or over and held a position of trust, authority or supervision in relation to the victim.

                    This means that for it to be rape you would have to have a position of trust or authority over the 13-18 year old - baby sitter, boss, etc. with your age 17 or over.

                    It would be sexual abuse if you were less than 5 years older that the "victim" if they were 13-17.

                    In IL, a 17 year old can give consent.

                    It's like in contracts - you cannot sign into a contract with just a minor and have any recourse if they back out. They cannot legally give consent.

                            Yes this is correct...It has been awhile since I have used the Ohio Revised code...but this is accurate to my recollection..
