Re: HHI/Kustom suing Neal Moser and MCS

Here is a good one for taking someone's idea:

I worked for a company mounting wheels and tires for tractor-trailors. When the wheels and tires came off the bead set, it was up to the poor guy on the backside to catch these tires ( full with 125 p.s.i.)and roll them into a tire rack.

An outside contractor came in to do some maintance and said " I have an idea !!" He designed a pneumatic catcher that would lay the tire on its tread and all you had to do was roll it away.....no more tires bouncing up and tearing your head off.

After testing, he called the higher ups, they came with their lawyer in tow...he showed them how it worked....and the lawyer filed for a patent right on the spot. Poor schlep lost the rights to his design and never stood a chance. I know, there are all these questions and scenarios about " If he did this" or he may have a legal fight....he doesnt. He took the company to court several times. Because they had the patent applied for first, they won.-Lou

You all must ask yourself this, too.

i'm not aware of what agreements neal had, just speaking in generalities. it's also possible the agreement terminated when BCR changed ownership.

If I remember correctly, when you buy a company, you get EVERYTHING that comes with it. That includes the deals and endorsements. As far as I know, when they stopped with the royalties, their rights to build the guitar were also jeorardized. It's the same as when you buy a car....if you quit paying on it, it gets repo'd.

I'm sure many of you here on the JCF have been over to Neals site and some are probably even members. True guitar enthusiests know the BC Rich history and who the dedicated and responsible parties were for their success. Neal was at the top of that list. The Fucktards at HHI have no clue and particularly don't really care about that, because all BC Rich is to them, is a name and a cash cow.

I'm not sure if it was ever posted here, but here is the news article that was posted on Blabbermouth when the Lawsuit first took place. As you read the responses, Jr102258 is actually Hellbelly/Jeff Reid, who is HHI's webmaster. He thought he was being a sneaky little boy

That's not how it works in the US. Here the first to invent wins, period. The issue is always proof. I'd imagine what happened is that they filed the patent and lied about who invented the mechanism substituting someone there for your friend in the space where the inventor's name appears on the application. Happens all the time.

REAM THOSE FUCKERS, Neal... if I´m not misinformed,HHI owes you quite a bit in past royalties, do they not?? And IIRC there are also shypes which are offically only "licensed out", no?? My first reaction would be payment demand, revocation of rights, and of course appropriate defensive and preemptive legal action

              Good luck

Man, those padded "looks like a ride from the fair" heads were an eyesore in the 70's. They actually didn't have bad club PA stuff for that time. I know Bren Aryans from Flipp (local talent) used or still uses these amps. I think he even is an endorser of them. Great if you play in a band that wants a circus clown look.
