  • Paypal, and assholes on eBay.

    Anyone know what more I can do with this.

    Okay, I won an item on eBay. 8712275132

    It's a dealer display case, one you would display like, sports cards in, at a show.

    The auction says it's in Good condition, and it is BLACK.

    Ignore everything else.











    Okay, that's what I got. A transparent red, piece of shit. I emailed the seller (totally forgetting about the black thing) saying it was damaged either, in transition to me, or by them, and I would like them to file a claim with UPS.

    They go back and forth with me through several emails. They become irate (and their grammar is awful, even worse than mine). This is a quote from their last known contact "im not going to continue to argue over this matter...you wanted me to file a claim ...and I did!! now your once again accusing me of sending the case damaged,,,I DID NOT FABRICATE THE CASE,,,finish scratches?? it was a USED CASE... it was shipped to your address and YOU recieved it and I can tell you that PAYPAL will refuse your claim because it was shipped!!! and recieved!!!"

    That email, was sent in response to two emails I sent. One addressing the issue, and another, with pictures of the case (I sent them as two seperate emails, they must have checked the one, and then got the other, after they replied, even though they were sent at the same time).

    I emailed them back, "There is no need to be hostile with me, I've done nothing wrong. I'll contact you, after 7 business days, to see if you've gotten the claim check".

    I waited 12 business days. I emailed...waited 2 days, heard nothing. I emailed 2 days later...nothing... I then file a claim with Paypal, and he emails them within 2 hours of the claim.

    I spoke to a Paypal representative that said, it can actually go in his favor, because he can prove he shipped it.

    Basically then, he can ship me a box of turds, and since he has a tracking number, who cares what is in it, it's kind of ridiculous.

    What other options do I have, if Paypal decides in this guys favor? (Anyone with eyes can see, should see, if they do side with him, that Paypal is a bunch of retards. I mean, come on, he sends me something that is broken, and not in the right color, and starts fighting with ME about it.).

    Any help would be greatly appreciated. Oh, I'm verified on Paypal, and confirmed. I also used my credit card via Paypal.

            I hate to say this, but I would just eat the loss. The hassle is not going to be worth it. You're out like $50, right? Maybe you can restore the case and still use it. It's a matter of $ vs time. There is no question that you got screwed. (I checked the auction.) [img]/images/graemlins/frown.gif[/img]

                  It's not about money, it's about principle of the matter, this fucker shouldn't get away with this.

                  If I leave him a negative, he leaves me one. Why would I deserve one? I paid for my item, and I only asked for HIS mess up and screw over to be fixed, but I'm some how at fault in this nimrods mind.

                    Deneb, you can file a "Fraud Protection Claim" through eBay. PayPal should advise you of that if you have filed and lost a claim through them. Go through the process step by step. Your first have to file a claim and be denied by PayPal to file the eBay "Fraud Protection Claim". I did not file with or use Square Trade arbitrator. PayPal does not get involved in the "item not as described" debate, but eBay will. I know, I had to file a claim on an RR3 Rhoads last year. It took a couple of months, but I did win the claim. Good luck.

                      Actually, if PayPal says you received the item, you can inform them that you did not receive the item that was listed for sale, but rather a substitute, given the fact that the listing stated a different color than what you received.

                        Yup. You'll prolly get one.

                        But over time, it works out. You'll have 1 neg and he'll have 10 negs. When someone looks at your neg and follows the links to this tool's feedback page and sees the 10 negs against him, they'll pretty much dismiss your neg.

                        That's the only way to get rid of these tards. The law of averages works against these fuckers even though each fuckee has to eat a neg.

                          Return the item, send it off exactly how you received it. Ship it in the same fashion as you received it. Call your credit company, tell them the item has been returned, that PayPal said they won't do anything, have them perform a chargeback (which PayPal will also charge the seller a $10 fee for, if I recall correctly), and then leave him a negative.

                          1) you get your money back 2) the seller loses additional funds 3) he'll get a negative 4) you'll have most of your money back

                          As for the negative you'll receive... Negatives for buying means little to nothing for buyers who sell. Negatives for selling is bad for the seller.

                          This is the way I see it. If you have 100 feedback, and are selling an item... if you have 10 positive sales with no negative sales feedback, the negative you receive as a buyer will mean nothing to me. So don't worry about it impacting any sales you think it might hurt.

                            If PayPal rejects your claim you can dispute it however at this point (From what I have read before) all you need to show is that you sent the item back to him. PayPal does now get into "Items not as described" but you will have to push the issue since PayPal's first resonce will be to tell you otherwise to try and make you go away.

                              Also bear in mind that if you do a cc chargeback overruling
                              Paypal's decision, Paypal will close your account. That would certainly be worth it over a big ticket item, but on a $50 item, is it worth it? Sorry you'll take a neg, that sucks. But people will consider the source of the neg feedback, looking at his other negs.
