lets ban together a fight the illegal actions of fender and gibson guitars
if i owned lets say gibson, i would let other companies make their versions,it would help keep me on my toes to make better ones than my competition.as well it helps with research and development of new techniques, and products.
lol lol
Pure Utopia. This isn't any kind of communism where everyone *TRIES* (still utopia) to do the best they can. It's business.
lets protest and send letters and fight against the ...
Commies! The reds are coming!

I suppose I can agree with you here, just trademarking a guitar body shape would be pretty dumb, there's so much more you can do. For example you could file a design patent and get an absolute monopoly for a number of years with none of the pesky limitations of trademarks. Of course patents eventually expire so you'd want to file a trademark application too since, after a few years of registration you can file an affidavit of incontestibility and make it a royal pain in the ass for anyone to challenge your mark. The trick is to time the trademark application so that no one ever gets a chance to actually oppose it before it becomes incontestible. While you're at it you'd also want to register your copyright in the new body shape because copyrights are the only type of IP that don't require you to prove actual damages to collect ... besides they're cheap so why not?

the only reason why they doing it is to get away with making low quality products because then you couldnt by lets say an explorer form jackson so gibson can keep getting cheapper on the manufacturing while charging you the same.
Actually they do it for much the same reason you lock your front door when you go out of town for an extended period of time: they, like you, would like to continue to own their hard-earned property.

hell they bought kramer whose most of kramers in the past was available left handed now since gibson bought them, maybe one or two are lefties.
Left handed guitars are an inherently esoteric product, lefties have far more serious concerns with regard to the widespread availability of left-handed products. For example, I've never seen a left handed bar of soap (or ... horror of horrors ... a left handed beer can). If all of those lefties can't clean up and get drunk how are they ever going to get laid? Now *that's* a problem!

the fact is if other companies are allow to make the a version of your model guitars,it does hurt you unless your so lazy you dont want to work harder to put out the better product.
In the same way it wouldn't hurt you at all if I broke into your home and stole your television set unless you were just too lazy to work hard enough to earn the money necessary to get another one.
its called competiton.
Actually it's called "theft".

what fender and gibson wants to do is monoploize when in business is unethical and illegal.
How dare they attempt to keep their own property!

so write to the trademark commison telling them to overturn and fix the trademarking law for guitar bodies shapes, etc.
Please do! That would be hilarious ... err, a great idea! Here's the address:
Commissioner for Trademarks P.O. Box 1451 Alexandria, VA 22313-1451
I'd suggest writing something lengthy so as to best completely explain your positions. Do please take the time to share any correspondence you might receive with us!

hell this would mean evem you building your own version of a explorer or strat, etc could be sued, down the road.
Sadly, no. Trademarks are only designed to protect consumers in the marketplace (that last word is key) so you would be in little danger from Gibson or Fender for your own personal projects that remain in your possession. Now if we were starting doing things my way ....

the main reason gibson stopped jackson is because jackson is now owned by fender.which is pathetic jealousy.is simplifies the greed in these companies that needs to be stop for the good of the companies and the musicians both.
Could someone translate this please? I'd prefer English but I've a sneaking suspicion that anything would be an improvement!

Actually that was the old Soviet way before the capitalists took over. Didn't work so well.

it seems these companies are no better than enron.
I've got to agree with Tim, this was the highlight of the entire post!

i can wait till some true musician buys both fender and gibson and eliminates those trademark restrictions.
Last time I checked someone like that had rescued Fender from CBS but things didn't quite go the way you'd have liked, no?

the only legal constitutional trademark is you cant make a les pual then put gibson name on it.otherwise those who just use the body/headstock shape are not breaking any legal trademark.
You're going to make someone else's lawyer a lot of money one of these days.

but gibson/fender pay those trademark comission people under the table to change the laws in their favor.
This would be an excellent topic to take up with the Commissioner of Trademarks!

we must fight back by petitionig against those traemark restrictions on other companies using so called trademark body/headstock shapes.
Да мы должны воевать для камрада людей.
OK, I'm finished burning CDs now.
Catapultam habeo. Nisi pecuniam omnem mihi dabis, ad caput tuum saxum immane mittam!
I was right! It just looks so much more elegant that way.
Brad, I've found that after many conversations with you over the years about a wide variety of topics that you are usually right at least in your own mind. :ROTF:
I want REAL change. I want dead bodies littering the capitol.
