Look at page two if you have not yet I broke down the arrest and pre-arrest question you had. With real legal terms not any cop double talk.

Just so you know when you say you want a lawyer for questioning. No Lawyer comes out to the scene and talks to the cops ever unless you are OJ. The cops dont say "Hold on lets call a lawyer for this guy." They just cuff you and stuff you.
You have to follow up with taking badge numbers and contacting the ACLU and the IA for the department to report a wrongful arrest if you are Not Charged.
I dont think cops even bother "interviewing" lawyers because a lawyers is just go to invoke the 5th for his client till court. Anything less and your lawyer is a dumptruck.

This is the same theory that follows gun control and why it's so asinine.

Not like I pay much attention to these, but this is funny. My horroscope for today:
"Today, you will become involved in a less than intellectual argument and it might not be one worth having. Make sure you aren't just being contrary because you want to stir up some excitement or because you just don't like the other person very much. You don't have to go out of your way to be harmonious, but you also don't have to go out of your way to disagree with them. If they are wrong, just let them be wrong. It's really not worth the energy to try and change their mind."
Hehehe... Weird how that popped up...

I never scolded/attacked or made fun of his injury or service.
Besides the fact that I was medically discharged from the Marine corps because of an injury I sustained overseas, his injury does NOT grant him the right to disrespect others. I hope you agree with me there.

Was your decision to make an arrest based on the fact that this guy didn't want to make a statement, or was it based on the fact that he was utterly disrespectful and deserved a kick in the ass?
Joel,
This is based on the fact that he would not give me his personal info when it is clear that I am obviously an officer. He doesn't have to tell me anything he has seen or knows, but, he does have to tell me his personal info.
In accordance to the Miranda and Ohio State law, he does not have to answer any questions that could implicate him as a suspect, however, if I ask for his personal information since it MAY be pertinant to the issue at hand, he has to give it to me. If not, that is considered obstruction of an officer while doing an investigation. Its a felony in Ohio, and I think its an F3 or F4 if I remember right. F3 being more serious.
These laws and the severity of punishment could vary from state to state, but, it seems almost all states have something similar in place.-LouLast edited by LouSiffer; 12-16-2008, 03:22 PM." I do not pay women for sex. I pay for them to leave after the sex ". -Wise words of Charlie Sheen
