This is based on the fact that he would not give me his personal info when it is clear that I am obviously an officer. He doesn't have to tell me anything he has seen or knows, but, he does have to tell me his personal info.

In accordance to the Miranda and Ohio State law, he does not have to answer any questions that could implicate him as a suspect, however, if I ask for his personal information since it MAY be pertinant to the issue at hand, he has to give it to me. If not, that is considered obstruction of an officer while doing an investigation. Its a felony in Ohio, and I think its an F3 or F4 if I remember right. F3 being more serious.

These laws and the severity of punishment could vary from state to state, but, it seems almost all states have something similar in place.-Lou

The guy was obviously an asshat and deserved to be arrested. I realize that he also broke the law by refusing to identify himself, but there is never anything good to gain by being an asshole to a cop.

I had a situation once where the police wanted to ask me questions regarding an altercation involving my step-daughter. After properly identifying myself, I responded in the following manner: "Officer, please don't take this personally because you seem like a helluva good guy, but I really think it's in my best interest to refrain from any further comment on this." to which the officer replied "No problem - we have your contact information and will contact you if we need anything further."

Amazing how far a little common respect goes.

And thats all you have to do. I think alot of times people get amped up on adrenaline or they have watched too many cop shows and think they know enough about the law that they can get away with being an ass.

A good officer will walk into a scene unbiased and open minded. We will make decisions to the best of our observations. We are not perfect, but, we do the best with what is layed before us which is usually with a very little amount of information.

It is easy to get into a "groove" and play the scenario out in your head a hundred times before you get to a scene ...i.e. Domestic Violence. 99% of the time, if there is a legit complaint, it is the male member of the household which has committed the offense. Which is also usually drunk/tweaked. That is a really easy "groove" to fall into regarding these calls, but, you always get that one that is different.

Just because you do not give up information and lawyer up, doesn't mean you are free to go. If there is enough probable cause, you will be jailed. However, interrogations must be stopped once you request a lawyer. You may be goaded indirectly, but, just keep to yourself and always be respectful.

Also, don't think blurting out all your wrong doings before you are read the Miranda will get you off on a technicality. That is considered Willful Information.

I actually had a dumbass try this on me regarding a child rape case. He was my suspect, I had no intentions of questioning him since I had enough PC to make a justified arrest. I would just let the detective do it. Got him in the car and he just started blurting out everything he did and how he did it and started laughing about it. He said since I didn't read him his Miranda Rights, he was going to get off. I pull out the tape from the onboard recorder and made 4 copies of it.....no way I was going to let this fuck get away cause of a bad or missing tape. Played said tape in front of him and his lawyer ....his layers head sunk.

He looks over at the child raping suspect and says I think we need to plea-bargain. He had to explain why the Miranda was a moot point in this scenario.

The prosecutor refused the plea-bargain. He is serving a 80 year sentence with parole possibilty in 50 years I think. He was in his late to mid 30's. Yeah, he is gone for life so to speak.-Lou
