Well, if a citizen shot someone, they had better be speaking to a lawyer before they make a statement, so there isn't much difference.

Except they aren't arresting the officer at that time like they would a civilian.

This whole thing has been about being in a simpler situation, like just a traffic stop and wanting a lawyer. I've said the whole time, if it's a serious charge or could become one, you need a lawyer.

Problem is most people dont know how serious a charge is they are talking themselves into.

Example someone one goes to a range with a rifle that has a detachable magazine not fixed to the receiver. Honest mistake but a felony none the less in California.

Some women lets the cop search their purse and they have a half broken moldy Vicodin tablet from a old dental surgery in the bottom of the bag from many years ago. Felony possesion.

If you carry medicine, common sense would tell you too keep it in a legitmate prescription bottle with your name on it.

So you dont have a problem arresting someone on a felony beef because they had a old Vicodin in their purse as in 1 pill they forgot about. No priors or history of LE interaction.

Common sence should be used in making arrests. To expect everyone to know all state and federal laws is ignorant. Are you gonna bust someone for taking the tag off the couch since the PC to search the residence was weak to begin with so you have to nail them on something since you did not find anything good?

You know if you posess more than 9 grams of sudafed you are commiting a felony now? Its a Federal beef as well. As in cold pills. You know how many pills equals 9 grams?

No, we have actual criminals to worry about. Many cops I spose might try do that tho. I think that's terrible. Usually, that won't stand unless it's combined with other stuff, and that would be bargained off fast.

If you are an absolute idiot to the cop, there is a lot more going on, priors/history, Then, even a cool cop may just use that to hem them, but most prosecutors in bigger cities would bargain that right off.

You (as you said) have to use common sense in doing stuff. Some cops like civilians, are lacking that. Lotsa less than outstandingly smart cops, lotsa dumbass people... Ugh...

That's why I wouldn't live in Kalifonia. We have it much easier here in that regard and it's not quite a problem like kali. I'd advise Kalifornians to closely know the laws regarding firearms that they posssess. I know more about my asthma than my doctors generally do... Know your own guidelines.

Here (and most big cities), it isn't a problem to find something good on someone that caught your attention (there's a reason they caught your attention usually), or just find a real criminal.

No reason to hem someone up that don't need it. Suburbs, well, they do some crappy things to people if they wanna hem them up. Our prosecutors here get mad if you start dogpiling BS charges.

That's quite messed up. That's generally about 30 pills. Especially whacky when they used to sell them in 48 count packs 2 years ago.
